We therefore cannot<\/strong> control vessel departure times, port arrival schedules, flight operations, port handling efficiency, or land transit timelines.\r\n\r\n1.3 We <strong>have no authority to influence, expedite, or interfere with any decision or operational timeline of customs, quarantine, border control, or other governmental authorities<\/strong>\u2014including but not limited to inspection decisions, duty assessments, release timing, or cargo destruction. All customs outcomes are independent governmental actions beyond Ebaoguo.COM&#8217;s control.\r\n\r\n<h3>Article 2: Customer&#8217;s Fundamental Obligations<\/h3>\r\n2.1 The customer must declare accurately, completely, and truthfully the product name, quantity, material, intended use, presence of batteries\/liquids, HS code, and declared value. <strong>The declared value per shipment must strictly comply with the customs regulations of the specific shipping route and destination country\/region.<\/strong> Undervaluation or over-declaration may result in seizure, fines, or return.\r\n\r\n2.2 The customer warrants that no undeclared items are concealed (&#8220;concealment&#8221; means actual contents differ from declaration, regardless of intent). Any false, fraudulent, or undervalued declaration constitutes a material breach of these terms.\r\n\r\n2.3 Consequences arising from incorrect declarations, concealed prohibited items, inadequate packaging, or selection of high-risk shipping methods (e.g., &#8220;sensitive goods&#8221; routes) shall be borne solely by the customer.\r\n\r\n2.4 The customer warrants that they are the legitimate sender and beneficial owner of the shipment. <strong>Resale or subletting of Ebaoguo.COM&#8217;s services to third parties without prior written consent is strictly prohibited.<\/strong> Any loss or liability arising from unauthorised resale shall be borne solely by the customer.\r\n\r\n<hr \/>\r\n\r\n<h2>Chapter II: Customs Clearance, Duties, and Government Action Exclusions<\/h2>\r\n<h3>Article 3: Customs Responsibility and Policy Change Exemption<\/h3>\r\n3.1 Only when Ebaoguo.COM explicitly labels a service as <strong>&#8220;DDP&#8221;<\/strong> or <strong>&#8220;Duties &amp; Taxes Paid&#8221;<\/strong> on its website or shipping system will customs clearance and duty payment be deemed included. Even then, final clearance remains subject to the destination customs authority&#8217;s discretion.\r\n\r\n3.2 For all services <strong>not<\/strong> marked as &#8220;Duties &amp; Taxes Paid,&#8221; <strong>customs clearance responsibility rests entirely with the recipient.<\/strong> Ebaoguo.COM does not prepay duties, provide customs brokerage, or assume liability for clearance failures.\r\n\r\n3.3 Ebaoguo.COM bears <strong>no liability<\/strong> for parcel detention, return, or destruction caused by sudden changes in import\/export laws, regulatory bans, or policy shifts in the destination or transit country (e.g., sudden prohibition of certain goods).\r\n\r\n<h3>Article 4: Exclusion of Liability for Delay-Induced Losses<\/h3>\r\n4.1 Ebaoguo.COM <strong>shall not be liable for any direct, indirect, or consequential damages<\/strong> resulting from delays, detentions, spoilage, expiration, functional failure, depreciation, or lost business opportunities caused by:\r\n(a) Customs inspections, random checks, document reviews, or policy enforcement;\r\n(b) Port congestion, strikes, weather, war, pandemics, or carrier capacity shortages;\r\n(c) Vessel\/flight cancellations, delays, or missed transshipments;\r\n(d) Recipient&#8217;s failure to respond to clearance notices or refusal to pay duties.\r\n\r\n4.2 <strong>Specifically emphasised:<\/strong> Natural deterioration due to such delays\u2014including but not limited to food expiration, cosmetic spoilage, flower wilting, battery degradation in electronics, or seasonal goods missing sales windows\u2014and any resulting commercial consequences (e.g., lost contracts, e-commerce penalties, order cancellations, or reputational harm) <strong>are expressly excluded from compensation.<\/strong>\r\n\r\n<hr \/>\r\n\r\n<h2>Chapter III: Liability Limits and Compensation Rules<\/h2>\r\n<h3>Article 5: Conditions and Caps on Compensation<\/h3>\r\n5.1 Ebaoguo.COM will consider limited compensation <strong>only if all<\/strong> of the following conditions are met:\r\n(a) The customer purchased a <strong>paid insurance plan<\/strong>;\r\n(b) The loss occurred during Ebaoguo.COM&#8217;s <strong>direct operational control<\/strong> (e.g., intake, warehousing, or repackaging);\r\n(c) The loss was <strong>not<\/strong> caused by customer breach, prohibited items, poor packaging, force majeure, government action, or third parties;\r\n(d) The customer submitted a complete claim within the statutory timeframe (see Article 8).\r\n\r\n5.2 Even if all conditions are satisfied, <strong>maximum compensation per shipment shall not exceed the greater of 3\u00d7 the paid shipping fee or USD 100 (one hundred US dollars).<\/strong> High-value items must be covered by separate commercial cargo insurance.\r\n\r\n<h3>Article 6: Absolute Exclusions from Compensation<\/h3>\r\nThe following are expressly and absolutely excluded from any compensation under any circumstances:\r\n<ol>\r\n \t<li>Any consequence from concealment, false declaration, undervaluation, or use of high-risk shipping routes;<\/li>\r\n \t<li>Natural spoilage, expiration, or failure of perishables (food, pharmaceuticals, cosmetics, flowers, liquids, powders, fragile items) due to transit or customs delays;<\/li>\r\n \t<li>Damage caused by transportation conditions (e.g., high temperatures, humidity, pressure changes) resulting in melting, deformation, alteration of properties, or packaging damage of items such as health supplements, cosmetics, oil-containing foods, or similar goods;<\/li>\r\n \t<li>High-value items: cash, jewellery, watches, artwork, collectibles, or unreported electronics;<\/li>\r\n \t<li>Loss or delay caused by third-party carriers, ports, airlines, postal systems, or force majeure;<\/li>\r\n \t<li>Indirect losses: lost profits, contractual penalties, platform fines, missed opportunities, brand damage, or financing costs;<\/li>\r\n \t<li>Abandonment or return due to the customer&#8217;s failure to respond to exception notices (e.g., no reply to customs email within <code>72 hours<\/code>);<\/li>\r\n \t<li>Any loss arising from undeclared batteries, prohibited items, or items that do not comply with applicable aviation or customs regulations.<\/li>\r\n<\/ol>\r\n\r\n<h3>Article 7: Third-Party Liability Disclaimers<\/h3>\r\n7.1 Transportation, customs clearance, and last-mile delivery are performed by independent third parties governed by their own terms of service.\r\n\r\n7.2 Ebaoguo.COM assumes <strong>no joint, secondary, vicarious, or derivative liability<\/strong> for any act or omission of such third parties.\r\n\r\n7.3 In the event of loss or damage caused by a third-party carrier, Ebaoguo.COM will, upon request, provide available tracking records and carrier documentation to assist the customer in pursuing a claim directly against the responsible carrier. This assistance does not constitute an assumption of liability by Ebaoguo.COM.\r\n\r\n<hr \/>\r\n\r\n<h2>Chapter IV: Claims Procedure and Time Limits<\/h2>\r\n<h3>Article 8: Strict Claims Deadlines<\/h3>\r\n8.1 Shipments <strong>without purchased insurance are not eligible for any compensation.<\/strong>\r\n\r\n8.2 Insured customers must submit complete claims via the Ebaoguo.COM website within the following deadlines:\r\n<div style=\"overflow-x:auto;-webkit-overflow-scrolling:touch;margin:14px 0\"><table>\r\n<thead>\r\n<tr>\r\n<th>Claim Reason<\/th>\r\n<th>Deadline to File<\/th>\r\n<th>Consequence of Late Filing<\/th>\r\n<\/tr>\r\n<\/thead>\r\n<tbody>\r\n<tr>\r\n<td>External damage \/ Shortage<\/td>\r\n<td>Within <strong>48 hours<\/strong> of delivery<\/td>\r\n<td>Deemed delivered in good condition<\/td>\r\n<\/tr>\r\n<tr>\r\n<td>Air freight total loss<\/td>\r\n<td>Within <strong>30 days<\/strong> of shipment<\/td>\r\n<td>Claim rejected<\/td>\r\n<\/tr>\r\n<tr>\r\n<td>Sea freight total loss<\/td>\r\n<td>Within <strong>60 days<\/strong> of shipment<\/td>\r\n<td>Claim rejected<\/td>\r\n<\/tr>\r\n<\/tbody>\r\n<\/table><\/div>\r\n\r\n8.3 Claims must include: proof of purchase (invoice), original packaging photographs, delivery confirmation, tracking records, and a written description of the loss. Incomplete submissions will not be processed until all required documents are received.\r\n\r\n<h3>Article 9: Delivery Completion upon Signature<\/h3>\r\n9.1 Any proof of delivery provided by the final carrier\u2014including electronic signature, photo confirmation, smart locker pickup, neighbour signing, or porch drop\u2014constitutes <strong>legally valid evidence of completed delivery.<\/strong>\r\n\r\n9.2 Customers may not dispute delivery or request compensation based on &#8220;not personally receiving&#8221; the parcel.\r\n\r\n9.3 If a customer believes a parcel has been delivered to the wrong address or stolen after delivery confirmation, the customer must report the incident to the relevant carrier and local authorities directly. Ebaoguo.COM bears no liability for post-delivery theft or misdelivery by the final carrier.\r\n\r\n<hr \/>\r\n\r\n<h2>Chapter V: Governing Law and Dispute Resolution<\/h2>\r\n<h3>Article 10: Governing Law Principle<\/h3>\r\n10.1 These terms are governed by international commercial practices and the laws of Ebaoguo.COM&#8217;s primary place of business.\r\n\r\n10.2 <strong>If mandatory consumer protection laws in the customer&#8217;s jurisdiction prohibit contractual waiver of certain rights, those mandatory provisions shall prevail.<\/strong> Ebaoguo.COM&#8217;s liability exclusions shall apply to the fullest extent permitted by such mandatory law.\r\n\r\n<h3>Article 11: Dispute Resolution Mechanism<\/h3>\r\n11.1 Parties shall first attempt to resolve disputes through Ebaoguo.COM&#8217;s customer service channel within <code>30 days<\/code> of the dispute arising.\r\n\r\n11.2 If unresolved, disputes shall be submitted to <strong>arbitration at the arbitration centre nearest to the origin warehouse location<\/strong>, conducted in English, with awards final and binding.\r\n\r\n11.3 <strong>However, if local law in the customer&#8217;s jurisdiction prohibits consumers from waiving litigation rights, the customer may file suit in a court of competent jurisdiction at their habitual residence.<\/strong> Ebaoguo.COM reserves the right to assert all applicable defences and liability exclusions.\r\n\r\n<hr \/>\r\n\r\n<h2>Chapter VI: Miscellaneous Provisions<\/h2>\r\n<h3>Article 12: Amendment and Notice<\/h3>\r\n12.1 Ebaoguo.COM reserves the right to amend these terms unilaterally. Revised terms will be posted on the website and <strong>take effect 7 days after publication.<\/strong>\r\n\r\n12.2 Continued use of the service constitutes acceptance of the latest version.\r\n\r\n12.3 It is the customer&#8217;s responsibility to review these terms periodically. Ebaoguo.COM is not obligated to provide individual notification of amendments.\r\n\r\n<h3>Article 13: Entire Agreement<\/h3>\r\n13.1 These terms constitute the <strong>entire and exclusive agreement<\/strong> between the parties regarding the service.\r\n\r\n13.2 Any oral statements, chat logs, social media posts, promotional materials, or email communications from customer service agents <strong>are void and non-binding unless confirmed in a written amendment signed by an authorised representative of Ebaoguo.COM.<\/strong>\r\n\r\n13.3 If any provision of these terms is found to be invalid or unenforceable under applicable law, the remaining provisions shall continue in full force and effect.\r\n\r\n<hr \/>\r\n\r\n<h2>Chapter VII: Prohibited Items, Penalties, and Right to Refuse Service<\/h2>\r\n<h3>Article 14: Prohibited Items and Battery Declaration<\/h3>\r\n14.1 The following items are <strong>strictly prohibited<\/strong> on all Ebaoguo.COM shipping routes:\r\n<ul>\r\n \t<li>Lithium batteries or lithium-ion batteries (unless on specifically approved routes)<\/li>\r\n \t<li>Flammable, explosive, or hazardous goods (e.g. lighters, fireworks, paint, chemical solvents, compressed gases)<\/li>\r\n \t<li>Narcotics, illegal drugs, and controlled substances<\/li>\r\n \t<li>Weapons, ammunition, and related components<\/li>\r\n \t<li>Live animals and plants<\/li>\r\n \t<li>Fresh perishables and unprocessed food<\/li>\r\n \t<li>Cash, currency, lottery tickets, and negotiable instruments<\/li>\r\n \t<li>Pornographic, gambling-related, or illegal publications<\/li>\r\n \t<li>Counterfeit goods and copyright-infringing products<\/li>\r\n \t<li>Any item prohibited by applicable aviation regulations or destination customs authorities<\/li>\r\n<\/ul>\r\n\r\n14.2 <strong>Battery Penalty:<\/strong> If a shipment is found to contain undeclared batteries upon inspection, the customer shall be liable for a penalty of no less than <code>AUD$220<\/code> per parcel, plus a return shipping fee of no less than <code>AUD$25<\/code> per parcel. If a single consignment contains multiple parcels, fees will be charged per parcel. Ebaoguo.COM reserves the right to pursue further legal remedies if the violation results in additional costs or regulatory penalties.\r\n\r\n14.3 Ebaoguo.COM reserves the right to <strong>refuse, return, hold, or dispose of<\/strong> any parcel found to contain prohibited items, without prior notice and without liability. All costs incurred (including return shipping, disposal, storage, and regulatory fines) shall be borne solely by the customer.\r\n\r\n<h3>Article 15: Account Responsibility and Authorised Use<\/h3>\r\n15.1 The customer is solely responsible for maintaining the confidentiality of their Ebaoguo.COM account credentials (username, password, Member ID). <strong>Ebaoguo.COM shall not be liable for any loss or damage arising from unauthorised access to a customer&#8217;s account due to the customer&#8217;s failure to safeguard their login information.<\/strong>\r\n\r\n15.2 The customer must notify Ebaoguo.COM immediately upon becoming aware of any unauthorised use of their account. Ebaoguo.COM reserves the right to suspend or terminate accounts suspected of misuse or security compromise.\r\n\r\n15.3 Each account is for the sole use of the registered individual or entity. <strong>Sharing, transferring, or reselling account access is strictly prohibited.<\/strong>\r\n\r\n<h3>Article 16: Warehouse Records and Parcel Condition Evidence<\/h3>\r\n16.1 Warehouse intake photographs and system records generated at the time of parcel receipt shall constitute <strong>prima facie evidence<\/strong> of the parcel&#8217;s condition, weight, and dimensions upon intake.\r\n\r\n16.2 Any damage, shortage, or discrepancy not documented at the time of intake shall be deemed to have occurred <strong>after<\/strong> Ebaoguo.COM&#8217;s receipt and will not be eligible for compensation under these terms.\r\n\r\n16.3 Customers are advised to ensure their shipments are adequately packaged before dispatch. Ebaoguo.COM&#8217;s acceptance of a parcel does not constitute a warranty of its packaging adequacy for international transit.\r\n\r\n<h3>Article 17: Parcel Consolidation, Splitting, and Weight Calculation<\/h3>\r\n17.1 Ebaoguo.COM reserves the right to <strong>consolidate multiple parcels addressed to the same recipient<\/strong> into a single shipment, or to split a single shipment into multiple parcels, at its operational discretion, without affecting the total chargeable weight calculation.\r\n\r\n17.2 Chargeable weight is calculated as the greater of actual weight and volumetric weight (<code>L\u00d7W\u00d7H cm \u00f7 5000<\/code>). Customers are responsible for verifying chargeable weight calculations prior to payment confirmation.\r\n\r\n17.3 Parcels from the same customer submitted under the same consignment reference may be combined for weight and volume calculations, or deferred to a subsequent dispatch batch.\r\n\r\n<h3>Article 18: Unclaimed and Abandoned Parcels<\/h3>\r\n18.1 Parcels that remain <strong>unclaimed, unpaid, or unresponsive for more than <code>60 days<\/code><\/strong> from the date of warehouse intake may be disposed of, donated, recycled, or destroyed by Ebaoguo.COM without further notice or liability to the customer.\r\n\r\n18.2 <strong>Storage fees may apply after <code>30 days<\/code><\/strong> of warehouse intake. Fee schedules are published on the Ebaoguo.COM website and subject to change without notice.\r\n\r\n18.3 Ebaoguo.COM shall not be liable for any loss of value, damage, or commercial consequence resulting from the disposal of unclaimed parcels in accordance with this Article.\r\n\r\n<h3>Article 19: Pricing, Surcharges, and Rate Changes<\/h3>\r\n19.1 All quoted shipping rates are <strong>estimates only<\/strong> and subject to change without notice due to carrier surcharges, fuel adjustments, currency fluctuations, peak season fees, remote area fees, or regulatory changes.\r\n\r\n19.2 The <strong>final billable amount will be confirmed at the time of dispatch<\/strong> based on actual weight, volumetric weight, destination, and applicable surcharges at that time.\r\n\r\n19.3 Continued use of Ebaoguo.COM&#8217;s services after any rate change constitutes the customer&#8217;s acceptance of the updated pricing.\r\n\r\n19.4 Ebaoguo.COM&#8217;s quoted prices include only the services explicitly stated. Any secondary charges arising at the destination (e.g., customs brokerage fees, address change fees, re-delivery fees, import duties) are <strong>not included<\/strong> unless expressly stated as &#8220;DDP&#8221; or &#8220;Duties &amp; Taxes Paid.&#8221;\r\n\r\n<hr \/>\r\n\r\n<div class=\"note\"><strong>\u26a0\ufe0f Important Notice:<\/strong> Ebaoguo.COM cannot control customs authorities, vessel schedules, flights, ports, or regulatory changes. Cross-border logistics inherently involves uncertainty. <strong>We do not assume liability for spoilage, expiration, commercial failure, or indirect losses caused by any delay.<\/strong>\r\n\r\nWe strongly advise you to:\r\n(1) Declare all items truthfully and comply with destination country regulations;\r\n(2) Purchase independent commercial cargo insurance for high-value or time-sensitive shipments;\r\n(3) Avoid shipping perishables, seasonal items, or goods with critical commercial timelines via standard consolidated shipping routes;\r\n(4) Respond promptly to all customs and exception notifications to avoid parcel abandonment;\r\n(5) Review these terms periodically as they are subject to change.\r\n\r\n<strong>By using this service, you acknowledge full understanding and
